General Terms and Conditions

These General Terms and Conditions applies to the sale of products (the “Products”) by Najell AB, reg. no 556819-7494, (“Najell”, “We” or “Us”) on Najell.com (the “Website”) between each consumer (the “Consumer” or “You”) and Najell. No derogation is valid unless with prior written consent of Najell.

1. Order and payment

Order confirmation

We will send an order confirmation to the email address You have provided as soon as your order has been registered in our system. In the order confirmation, You will find all the details about your purchased Product(s), price, billing details and shipping information. If You don’t receive an order confirmation, please check your spam and junk folders before contacting us.

If there is anything wrong in the order confirmation, You should immediately contact us at help@najell.com.

Price

All prices on the Websites are specified in Euro (€) and include VAT. When ordering via the Website, the prices specified on the Website apply. The prices do not include payment charges, delivery and invoicing charges or similar, which may be added and are specified separately.

Najell reserves the right to revise the prices specified on the Website at any time. In the case of an error in our pricing, we will inform You and You will then be given the option of cancelling or re-confirming your order at the correct price. Najell cannot be held responsible for incorrect publication of prices by third parties. 

Methods of payment

You may choose to pay for your order among the offered payment methods at the check-out of the purchase process on the Website.

We accept:

  • Card or credit card (e.g. VISA, Mastercard, American Express). 

  • Payment through Swish

  • Invoice by Klarna (not available in all countries). The invoice will be sent to your specified email address in connection with your order being sent from our warehouse. The payment period is 30 days. Klarna has its own terms of use and handling of the buyer’s personal data. These conditions are available when choosing a payment method at the check-out of the purchase process on the Najell Websites.

Discount codes

Discount codes can’t be combined with other sales or discount codes on the Website.

Sales/offers

Najell reserves the right to cancel the purchase of discounted goods if the stock balance has not been updated correctly and the goods have therefore run out of stock.

2. Personal data

When completing an order at the Website, You agree to your information being registered. Your information is used to administrate and fulfil your order. We protect your privacy and do not collect more information than necessary to process your order. We never sell or give your information to third parties.

Najell AB is responsible for the processing of personal data that You have provided to us as a Consumer. According to the GDPR (General Data Protection Regulation), You have the right to receive the information we have registered on you. If You consider it to be incorrect or irrelevant, You can request correction or removal from our Consumer register. If You want your information to be corrected or removed, please contact us at help@najell.com. The information You provide about yourself is only used internally. For more details concerning Najell’s data processing activities, please consult our privacy policy.

3. Delivery times and fees

Shipping within European Union (EU)

We offer free shipping options for orders within the EU, the UK and Norway.

Shipping outside European Union (EU)

For orders outside of the EU, cost for shipping will be added. You may choose among the, from time to time, offered shipping alternatives and see the additional costs at the check-out of the purchase process on the Website. If You live outside the European Union You might have to pay duty fees when receiving your parcel. For specific VAT and taxes in your country please contact your local customs office.

Delivery time

We deliver your order to your closest post office or delivery point normally within 3-5 working days in Europe. For orders outside of Europe, delivery time may vary.

Orders made on a weekend or a Swedish holiday will be shipped the next working day. Orders made during peak seasons or holiday periods may take longer to arrive. This is due to higher amount of deliveries by the carriers and is outside of Najell’s control.

You will receive an email when your order has been shipped and when it will be delivered to your home or is available for pickup at your local postal office.

Delivery to local service point or postal office

You will receive an email when your order leaves our warehouse and when your package is available for collection at your local postal office.

When collecting, make sure that the package is not damaged and if so, report this to Najell as soon as possible.

Home delivery

You will receive an email when your order leaves our warehouse, and receive a tracking number which allows You to follow your order and make any necessary changes.

Non-collection of a parcel

When collecting, make sure that the package is not damaged and if so, report this to Najell as soon as possible.

If You have changed your mind by the time the parcel has been sent from us and would like to withdraw from the purchase, You must collect the parcel at your delivery point and therafter send it back to us. If the parcel is not being collected, it is automatically registered as non-collected and charged accordingly.

4. Returns and exchange

Right of withdrawal and returns

Your right of withdrawal of a purchase of Products at ordinary price is valid for 30 days and 14 days for discounted Products from the date You received your order.

To exercise your right of withdrawal You are required to write and inform Najell about your decision to cancel the purchase. You may choose to inform Najell by using Najell’s standard withdrawal form that you can download here but it is not compulsory. Please note that a non-collected parcel is not considered a withdrawal or return.

You have the right to examine the Product(s), but it must be returned in an unused condition and in its original packaging. Najell may reduce a refund by an amount that reflects the Product's depreciation as a result of the Consumer’s handling of the Product which goes beyond what is necessary to examine the Product(s).

Returns 

The Product(s) must be returned without undue delay, and in any circumstance within 14 days from the date the Consumer informed Najell of the decision to cancel the purchase.

All returned items should be wrapped and well-packaged so that the parcel is not damaged. You may not tape or paste anything directly on the Product’s original packaging. Please note that You are responsible if the Product disappears or deteriorates during return shipping, so make sure to package it well. Najell AB is not responsible for lost parcels

Returns for the EU, UK, and Norway

Please use the prepaid return waybill to return the Product(s). When You make a return, a cost of 6€ will be charged for returns from the EU and Norway and a cost of 12 GBP from the UK. If You have not received a return waybill, email help@najell.com. Returns cannot be made as cash on delivery.

For all other countries

The Consumer is responsible for all direct costs of returning the Product(s). The Product(s) shall be sent to:

Refunds

As soon as your return is processed and approved, You will be refunded in the same way You paid for the Product(s). It may take up to 7 working days for our warehouse to process your return after it has arrived at our warehouse. We will refund You no later than 14 days after your return has been processed and approved.

On the refund amount, we reserve the right to deduct an amount corresponding to the decrease in value compared to the original value of the Product(s) when the Product(s) is used or damaged.

5. Exchange an item

If You want to exchange an item, simply:

  • Make a new order on our Website for the item You want to change to.

  • Fill out the return form that arrived with your order.

  • Send the Product(s) back to us, together with the return form. If You don’t have the form, please email us at help@najell.com.

We will refund You within 14 days after your return has been processed and approved. You can then place a new order. If a Product is defect and depending on the individual circumstances You may demand rectification, delivery of substitute goods, a price reduction or compensation to rectify the defect, or cancel the sale. If You need to make a complaint, You should always notify us by sending an email to help@najell.com before any Product(s) is sent back to us and within a reasonable time after You have observed the defect. Please attach photos of the Product(s) in the email if possible.

If we have approved your complaint and received the Product(s), we will send You a new Product(s), provided that it is in stock. If the item is not in stock, we will refund You what You have paid for the item..

Claims can only be applied to original manufacturing defects, and not defects that occur due to the Consumer’s use of the Product not in accordance with the Product manual that was included in the delivery of the Product(s). 

7. Applicable law and Disagreements

The purchase and these General Terms and Conditions shall be governed by the substantive law of Sweden. 

To have a dispute tried, you may contact the National Board for Consumer Disputes (Sw. Allmänna Reklamationsnämnden, ARN). Information on how to report a matter to the National Board for Consumers can be found at www.arn.se.

You may also submit a complain directly online via the European Commission’s Online Dispute Resolution platform, which can be found via the following link: https://ec.europa.eu/consumers/odr.  If you submit a complain via this platform, your case will be automatically forwarded to the correct competent nationally responsible dispute resolution body. The dispute resolution body will contact Najell and try to resolve the dispute without involving a court.

Any dispute relating to the purchase and these General Terms and Conditions or which otherwise concern the legal relationship between You and Najell, and which cannot be settled otherwise, shall be settled by a Swedish general court.

8. Reservations

The Najell Websites are currently available in Swedish, English, French, German, Danish, Dutch and Norwegian which allows placing an order in any of these languages. In case of discrepancy between the English version of General Terms and Conditions and its translation, the English version shall prevail.

Najell accepts no liability if Products run out of stock, as well as any image and writing errors on the website, errors in product description or technical specification, incorrect prices or incorrect information.

Najell reserves the right to make changes to these Terms, without prior notice. If these terms are changed, they updated and the previous general terms and conditions will be available on the Website.
